Terms and Conditions with effect from 1st May 2010

General

  • A Registration Charge of GBP65 is payable once per course in addition to your weekly course and accommodation fees.  This covers local meeting on arrival, local transfer at the end of your course, drinks during your breaks, school course materials, and other expenses connected with your course and accommodation.
  • You must pay a deposit of GBP200 with your application form (deducted from your invoice total).
  • You must pay the balance 3 weeks before your course begins.
  • If your course begins in less than 3 weeks you must pay 100% in advance.
  • If you need a visa to enter the UK you must pay 100% of your total fees in advance. If you do not receive your visa we will refund all of your money, less any bank charges.
  • Currently there is no VAT tax on English language courses or accommodation.

School & Course Details

  • Lessons take place from 09h00 - 16h30 Monday - Thursday, and 09h00 - 12h15 on Friday.
  • Friday Restaurant takes place from 12h15 - 15h15 on Friday. Your meal and wine are included in the course fees. If you choose not to go to the restaurant we cannot refund any part of your course fees.
  • Social breaks take place at 10h30 and 15h00 daily.
  • The minimum age of students is 21 years. There is no maximum. 
  • The typical age range is 25 - 55 years.
  • Complete beginners are only accepted on One-to-One courses.
  • Courses begin every Monday except BXG which is once a month and are subject to availability.
  • The school is open over Christmas and New Year period but is closed on the Public Holidays December 25, December 26 and January 1. On other Public Holidays the school is closed and there is a full day trip instead of lessons. Public Holidays in 2010 are :  5th April, 31st May and 30th August. The School will be open as normal on Good Friday 2nd April and Mayday holiday Monday 3rd May.
  • Insurance cover is provided for school premises and vehicles. We recommend that you arrange your own insurance for your possessions or medical expenses.

Cancellations 

  • 48 hrs or more before your course begins we will refund all of the money we have received from you less any expenses incurred by us
  • 48 hrs or less, or after your course has started we do not refund any money except in the case of your illness or a family death. In this case any refund is at the discretion of the school
  • Accommodation : Homestay : If you cancel your course 1 week or less before it starts we will charge you one week's accommodation.
  • Accommodation : Homestay : If you want to change homestay we require 1 whole week's notice from the following weekend (or payment instead)
  • Accommodation : Kingsway Serviced Apartments : If you cancel your booking less than 3 weeks before your course begins we will not refund any accommodation money to you unless we can sell the apartment to another person.
  • Accommodation : Hotel : if you want to change or cancel your hotel reservation the contract is between you and the hotel so you will have to observe the hotel's cancellation policy.


Force Majeure – Additions to our Terms and Conditions – with effect from 1st May 2010

What is “force majeure”?

From Wikipedia : Force majeure (French for "superior force") is a common clause in contracts which essentially frees both parties from liability or obligation when an extraordinary event or circumstance beyond the control of the parties, such as a war, strike, riot, crime, or an event described by the legal term "act of God" (e.g., flooding, earthquake, volcanic eruption), prevents one or both parties from fulfilling their obligations under the contract.

Why has Kingsway adopted a Force Majeure set of Terms and Conditions?

The recent volcanic cloud from Iceland has caused minor travel inconvenience to Kingsway students on two occasions so far this year which meant some staying over for one or two extra nights and others unable to arrive to start their courses.

We want to make it clear what the financial consequences are for both Kingsway and you because we think that is the fair way to operate.

Force Majeure – The Terms and Conditions

1.0 Arriving Students.  If you are unable to travel to start your course on the correct date you can:

1.1 Travel on the next available day and join your course as soon as possible. In this case you may lose one or two days of lessons (at your own cost) but this may sometimes be a sensible choice.

  • We will pay your homestay as though you had arrived on the correct date.
  • If you requested an arrival transfer we will pick you up free of charge, even if our driver already made a journey to the airport on the correct date.

1.2 Postpone (delay) your course to another time

  • We will credit 100% of your invoiced value to your new booking.
  • If you re-book your course in the following year you will need to pay any price increases (if there are any).
  • When you re-book your course we will issue a new invoice with all the normal charges and then deduct the amount of the credit from the previous booking
  • If you need a new documents by DHL you will be charged for these.

1.3 Cancel your course completely

  • We will apply our normal cancellation policy – see “Cancellations”

2.0 Departing Students.  If you are already at Kingsway and due to leave we will take you to your place of departure as requested on your booking form. If you are unable to leave from your place of departure you can:

2.1 Make your own arrangements at your own expense (for example stay in a hotel at the airport and travel home as soon as possible)

2.2 Return to Worcester and your previous accommodation if available. If you choose this option:

  • We will take you back to Worcester at no extra cost
  • We will try to arrange the same homestay or hotel if possible
  • You must pay your hotel as normal or
  • If you are staying with a homestay you must pay Kingsway the normal weekly rate ‘pro-rata’ for the number of extra nights you stay
  • We will allow you to come to school for these extra days and use the self-access and other school facilities free of charge
  • If there are places available for these extra days in group classes at your level we will allow you to join these classes free of charge

2.3 Rebooking your travel home. When you are able to reschedule your travel:

  • We will help you free of charge with rebooking your travel tickets etc but any extra travel costs must be paid by you
  • We will take you to your place of departure if you wish but you must pay for this transfer service at the full cost (the normal price we charge you is subsidised by us)
  • If you require this transfer service several times (for example if your second flight is cancelled) you must pay the full cost for each transfer
